WYR? — Terms of Service & End User License Agreement

Welcome to WYR? ("WYR?," the "App," "we," "us," or "our," operated by Mayer Sancivieri). These Terms of Service and End User License Agreement (together, the "Terms") are a binding agreement between you and WYR? governing your use of the App and its features, including the community pack library. Please read them carefully.
By downloading, accessing, or using WYR?, you agree to these Terms. If you do not agree, do not use the App.
If you use community features (publishing, browsing, or installing community packs), you also agree to our Community Guidelines, which are incorporated into these Terms.
1. Who can use WYR?
You must be at least 13 years old to use WYR?. If you are under the age of majority where you live, you may only use WYR? with the involvement of a parent or guardian who agrees to these Terms on your behalf. By using the App you represent that you meet these requirements.
WYR? is designed for couples and includes playful and flirtatious themes. Some question packs — including packs written and published by other users — are aimed at an older audience. Use your judgement about which packs you play, and see our Community Guidelines for what is and is not allowed in published packs.
2. Your account, and playing solo or as a duo
You can use WYR? on your own or paired with another person as a "duo." Pairing links your account to theirs and shares most of your WYR? data — rounds, reels, streak, subscription — between you. Anything you make before pairing carries over when you pair.
You are responsible for activity that occurs through your account and for keeping your sign-in credentials secure. You may not impersonate anyone or misrepresent your identity.
3. The service
WYR? lets you answer "Would You Rather" prompts — alone or with your person — record shareable reels, create custom question packs, and, through the community library, publish your packs for other users and install packs others have published. Some modes are played together on two phones and use your cameras and microphones; others are played on a single device. We may add, change, or remove features and modes at any time.
4. Subscriptions and payments (WYR? Pro)
4.1 Paid subscriptions
Some features require a paid subscription ("WYR? Pro"). Subscriptions are sold through the Apple App Store and are subject to Apple's terms. Auto‑renewing subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; manage or cancel in your Apple account settings. Prices may change with notice. Except where required by law or Apple policy, payments are non‑refundable.
4.2 Referral rewards (free Pro months)
WYR? offers a referral programme. You can share your referral code with other people; when someone who used your code pairs up with their partner, both you and they receive one free month of WYR? Pro.
How it works, and its limits:
- The reward is earned on pairing, not on signup. Nothing is granted when someone installs the App or creates an account.
- A referral code can only be used by someone new. You cannot use a referral code if you have already paired with someone, or if you have already used a referral code before. Each person may be referred once, ever.
- You cannot refer your own partner. If the person who used your code pairs with you, no reward is granted to either of you.
- Free months stack with any free months you already hold, and are added on top of a paid subscription rather than replacing it.
- A referrer may earn up to 12 free months in total. There is no limit on how many people you may invite.
- Free months are not a purchase. They have no cash value, cannot be sold, transferred, or exchanged, are not refundable, and will never automatically convert into a paid subscription or charge you anything. When free months run out, Pro features simply stop until you subscribe.
- Deleting your account forfeits any unused free months, and cancels any referral of yours that has not yet been rewarded.
We may withhold, void, or reverse referral rewards, and suspend accounts, where we reasonably believe the programme is being abused — including through duplicate, automated, or fake accounts, or coordinated pairing intended solely to generate rewards. We may change, suspend, or end the referral programme at any time; free months already granted will not be taken away except in cases of abuse.
5. User‑generated content and the community library
The WYR? community library lets you publish text question packs ("Your Content") and install packs published by others. This Section governs all user‑generated content.
5.1 You are responsible for Your Content
You are solely responsible for anything you publish. You represent that you own or have the rights to Your Content and that it does not violate these Terms, the Community Guidelines, or any law or third‑party right.
5.2 License you grant
When you publish a pack, you grant WYR? and other users a worldwide, non‑exclusive, royalty‑free license to host, store, reproduce, display, distribute, and — for users who install it — copy Your Content within the App for the purpose of operating and providing WYR?. Publishing creates independent copies: when another couple installs your pack, they receive their own copy, and later edits, unpublishing, or removal by us or you do not automatically retract copies already installed on other devices. You retain ownership of Your Content.
5.3 Zero‑tolerance policy for objectionable content
There is zero tolerance for objectionable content or abusive behavior. You may not publish, and Your Content may not contain, anything that:
- is sexually explicit or pornographic, or that sexualizes, depicts, or endangers minors in any way;
- is hateful, harassing, threatening, defamatory, or that promotes violence, self‑harm, or discrimination against people based on race, ethnicity, national origin, religion, disability, gender, gender identity, sexual orientation, age, or any protected characteristic;
- exposes another person's private or personally identifying information ("doxxing");
- is illegal, promotes illegal acts, or facilitates fraud;
- infringes anyone's intellectual property or other rights;
- is spam, a scam, malware, or otherwise deceptive or manipulative.
5.4 Our moderation rights
We may review, filter, refuse, hide, remove, or restrict any content, and suspend or permanently ban any user, at any time and without prior notice, at our sole discretion — including through automated filtering at publish time and automatic hiding of reported content. We are not obligated to publish or preserve any content.
5.5 Reporting and our commitment to act
Every community pack includes a Report control (••• → Report). You can also contact us at support@thewyrapp.com to report objectionable content or abusive users. Reported packs are automatically hidden pending review. We will review reports and remove violating content and eject the users who provided it, generally within 24 hours.
5.6 Blocking
You can block any publisher from a pack's ••• menu. Once blocked, you will no longer see that publisher's packs. Blocking is one‑directional and immediate.
5.7 No expectation of privacy for published content
Content you choose to publish to the community is visible to other users. Do not publish anything you consider private. (Your recorded reels are never part of the community library and are not shared through it.)
6. Acceptable use
You agree not to: use the App for any unlawful purpose; harass, abuse, or harm another person; attempt to access accounts, data, or systems you are not authorized to access; probe, scan, or test the vulnerability of our systems; scrape, reverse engineer, or circumvent security or rate limits; or interfere with the App's operation. Violations may result in immediate suspension or termination.
7. Intellectual property
The App, its design, and its original content (excluding user‑generated content) are owned by WYR? and protected by law. We grant you a limited, non‑exclusive, non‑transferable, revocable license to use the App for personal, non‑commercial purposes under these Terms. If you believe content in the App infringes your copyright, contact support@thewyrapp.com with details sufficient to identify the work and the allegedly infringing material, and we will respond appropriately.
8. Termination
You may stop using the App at any time. We may suspend or terminate your access at any time, with or without notice, including for any violation of these Terms. Sections that by their nature should survive termination (including Sections 5, 7, 9, 10, and 11) survive.
9. Disclaimers
THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. We do not warrant that the App will be uninterrupted, secure, or error‑free, or that user‑generated content is accurate, appropriate, or lawful. Community packs are created by other users; we do not endorse them.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WYR? WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP OR ANY USER‑GENERATED CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $50.
11. Indemnification
You agree to indemnify and hold harmless WYR? from any claims, damages, losses, and expenses (including reasonable legal fees) arising from Your Content, your use of the App, or your violation of these Terms or the rights of any third party.
12. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date and, where appropriate, notify you in the App. Your continued use after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict‑of‑laws rules, except where local consumer‑protection law provides otherwise.
14. Apple App Store additional terms
These Terms are between you and WYR? only, not with Apple. Apple is not responsible for the App or its content. To the extent required by Apple:
- Your license to use the App is a non‑transferable license to use it on any Apple‑branded device you own or control, as permitted by the App Store Terms of Service.
- Apple has no obligation to provide maintenance or support for the App.
- To the maximum extent permitted by law, Apple has no warranty obligation for the App, and any claims of non‑conformance to warranty are our responsibility, not Apple's.
- Apple is not responsible for addressing any claims by you or a third party relating to the App, including product‑liability, legal‑or‑regulatory, or consumer‑protection claims.
- Apple and its subsidiaries are third‑party beneficiaries of these Terms and may enforce them against you.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist‑supporting," and are not on any U.S. Government restricted‑party list.
